PIL filed for Patient Safety Opposing the “Dumping” of Outdated Medical Equipment

The Delhi-based non-profit Patient Safety and Access Initiative of India Foundation (PSAIIF), which aims to increase access to high-quality healthcare, has filed a Public Interest Litigation (PIL) before the Delhi High Court, voicing concerns about the regulatory framework’s laxity regarding the efficacy, safety, and quality of used or second-hand medical devices in India.

A thorough examination of the legal framework governing the entry of reconditioned or used medical equipment into the nation is sought in the writ petition submitted to the court. Copy of PIL is in Business Standard’s possession.

The PIL filed by PSAIIF claims that India is being used as a “dumping ground” for medical devices, and that the cause of action also arises from the fact that these devices pose an inherent safety risk to the lives of the general public, who are being operated on or diagnosed in hospitals using these used, refurbished, or reconditioned medical devices.
